Terms and Conditions

By purchasing coaching services with Jayde Hanna, you agree to the following terms:

1. Scope of Services and Professional Disclaimer

Coaching and hypnotherapy services provided by Jayde Hanna are intended for personal growth, emotional wellbeing, and relationship development. These services may involve therapeutic techniques, including hypnosis, neurolinguistic programming (NLP), or coaching frameworks, but they are not a substitute for clinical psychology, psychiatric treatment, or medical care.
Jayde Hanna is not a registered psychologist, psychiatrist, or medical doctor. Clients are responsible for seeking appropriate medical, legal, or financial advice where required. If a client presents with issues outside the Coach’s professional scope, they may be referred to another provider.

2. Informed Consent

By entering into this agreement, clients confirm they understand the nature of coaching, including its scope, boundaries, and limitations. Clients confirm they are mentally and emotionally capable of engaging with the process and acknowledge that their outcomes depend on their own participation, reflection, and effort. Clients may withdraw from coaching at any time, acknowledging that standard cancellation and refund policies will still apply.

3. Confidentiality and Emergency Protocol

All information shared during coaching sessions is strictly confidential and will not be disclosed without the client’s written consent, except where disclosure is required by law or where there is a risk of harm to the client or others.
Clients must provide an emergency contact to be used only in situations where immediate intervention is necessary due to serious risk. The Coach is not a crisis service and does not provide emergency support. In the event of a mental health emergency, clients must contact emergency services or a local crisis helpline.

4. Sessions and Support

Clients are entitled to 8 x 45-60-minute sessions (individual or couples) via Zoom, to be used within 16 weeks of the first session. Sessions may be extended in cases where the Coach becomes unavailable for an extended period due to serious illness, maternity leave, or other unforeseen events.
If a client fails to schedule or attend sessions within the 16-week timeframe and does not communicate with the Coach, the remaining sessions will be forfeited unless an extension has been agreed upon in writing.

Clients also have access to text and email support between sessions. This is intended for brief updates or clarifications. Messages will be responded to within 48 business hours during regular working hours (Mon–Fri, 9am–5pm ACST). Crisis support is not provided.

Session policies:

  • Sessions cancelled with less than 24 hours’ notice will be forfeited.

  • Clients may reschedule up to two sessions during the program.

  • If a client is more than 15 minutes late without prior notice, the session will be forfeited without the option for rescheduling or refund.

5. Client Responsibilities

Clients are expected to:

  • Attend all scheduled sessions punctually.

  • Actively participate and complete any assigned exercises.

  • Communicate openly and take personal responsibility for their progress.

  • Provide a minimum of 24 hours' notice for cancellations or rescheduling.

  • Ensure timely payment for services. Failure to do so may result in suspension or termination of services.

6. Fees and Payment

The total cost payable for coaching services is as reflected at the time of purchase. Payment may be made in full or via an agreed payment plan, in Australian Dollars (AUD).
Failure to make payment in accordance with the agreed schedule may result in services being suspended. A late payment fee of $50 per day applies, capped at $250 per week. Access to coaching services and support may be withheld until the account is brought up to date.

7. Refund and Cancellation Policy

Clients are entitled to a 7-day cooling-off period from the date of purchase to request a full refund, provided no coaching services have commenced.

Coaching services are deemed to have commenced if any of the following occur:

  • The client attends or schedules a session

  • The client accesses program materials, templates, or resources

  • The client engages in email or text-based support

  • The client participates in any onboarding process

Once coaching has commenced or the cooling-off period has passed:

  • No refunds will be given for change of mind or early termination

  • Clients remain liable for the full cost of the program, regardless of participation

  • In exceptional cases, the Coach may agree to early termination. If approved, a $500 termination fee will apply

  • Requests for financial hardship accommodations must be submitted in writing with supporting documentation.

  • Approval of a hardship plan does not waive the outstanding balance. It only adjusts the payment schedule. A formal payment agreement may be required. Continued non-payment may result in engagement of a third-party debt recovery service

These terms do not limit any rights clients may have under the Australian Consumer Law (ACL).

8. Dispute Resolution

Clients agree to raise any concerns or disputes in writing to hello@jaydehanna.com before pursuing any external remedies. By entering into this agreement, the client agrees not to initiate a chargeback without first following this dispute resolution process.
Unauthorised chargebacks may result in formal recovery proceedings, including administrative and legal costs.

In the event of an unresolved dispute, both parties agree to attempt mediation with a neutral third party before initiating legal action.

9. Waiver of Liability and Indemnity

Clients understand that outcomes are not guaranteed and that results depend on their own commitment and implementation of strategies. The Coach is not liable for any direct, indirect, incidental, or consequential loss arising from the use of coaching services.
Clients agree to indemnify and hold the Coach harmless from any claims, actions, damages, or liabilities arising from their participation in coaching.

10. Intellectual Property

All content, resources, exercises, and materials provided during coaching remain the sole intellectual property of Jayde Hanna. Clients receive a non-transferable licence for personal use only. Materials may not be copied, reproduced, shared, or distributed without the Coach’s prior written consent.

11. Force Majeure

Neither party will be liable for delays or failures in performance due to circumstances beyond their reasonable control. This includes but is not limited to natural disasters, technical disruptions, illness, maternity leave, or government-imposed restrictions. Efforts will be made to reschedule any affected sessions as soon as practicable.

12. Conduct and Right to Terminate

The Coach reserves the right to immediately terminate services, without refund, if the client engages in abusive behaviour, breaches confidentiality, violates personal or professional boundaries, or otherwise acts in a manner deemed inappropriate, unethical, or harmful.
Any remaining financial obligations will still apply.

13. Technology and Digital Access

The Coach is not responsible for third-party platform outages, access errors, or digital disruptions beyond her control. While reasonable steps will be taken to provide support, no refunds will be issued for temporary technology-related interruptions.

14. Governing Law

These Terms and Conditions are governed by the laws of South Australia. Any legal proceedings arising out of this agreement shall be subject to the exclusive jurisdiction of the courts of South Australia.

15. Acknowledgement

By proceeding with payment, you confirm that you have read, understood, and agreed to these Terms and Conditions. You acknowledge that this is a legally binding agreement and that once coaching has commenced, you forfeit the right to claim a refund under the cooling-off period.
